1. Your Right to Opt Out
Under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), as well as similar state privacy laws, you have the right to direct Heroic not to sell or share your personal information for purposes of cross-context behavioral advertising.
Under CPRA, “sale” means selling, renting, releasing, disclosing, disseminating, sharing, transferring, or otherwise communicating a consumer’s personal information to a third party in exchange for money or other valuable consideration.
Under CPRA, “sharing” means sharing personal information for purposes of cross-context behavioral advertising, whether or not for monetary or other consideration.
Philosopher's Notes is committed to respecting your privacy rights. If you wish to opt out of the sale or sharing of your personal information, please follow the mechanisms described below.
2. How to Opt Out
We provide three methods for you to opt out of the sale or sharing of your personal information:
Option 1: Cookie preference center
Click the “Cookie Settings” or “Cookie Preferences” link in the footer of the Services to access our cookie preference center. You can:
- Review the categories of cookies we use
- Reject “Targeting” and “Advertising” cookie categories
- Save your preferences
Rejecting these categories prevents us from deploying cookies and pixels that constitute “sale” or “sharing” as defined by the CPRA.
Option 2: Global Privacy Control (GPC)
Enable the Global Privacy Control (GPC) signal in your browser or device:
- We automatically detect the GPC signal and suppress non-essential cookies via our consent management platform
- GPC operates at the browser/device level, so you must enable it on each device and browser you use
- GPC is recognized as a valid opt-out signal under the CPRA
For help enabling GPC, visit the GPC website or consult your browser documentation.
Option 3: Direct request
You can submit a written opt-out request directly to us:
- You may also submit your request directly by completing our Opt-Out Request Form here.
- Email: support@heroic.us
- Mail: Heroic Enterprises, Public Benefit Corporation, 9901 Brodie Lane, Suite 160 #1388, Austin, TX 78748
Please include “Opt-Out of Sale/Sharing” or “Do Not Sell or Share” in the subject line.
3. What Happens When You Opt Out
When you opt out through any of the methods above, we will:
Suppress non-essential cookies and pixels
We will not deploy cookies, pixels, or other tracking technologies that constitute “sale” or “sharing” under the CPRA. This includes:
- Advertising and targeting cookies
- Behavioral advertising pixels (Meta Pixel, Google Ads, LinkedIn Insight Tag, etc.)
- Third-party analytics cookies used for cross-site tracking
Communicate preferences downstream
We will notify our applicable advertising and analytics partners of your opt-out preference so they do not:
- Set cookies or pixels on your device via our Services
- Collect or process your personal information for sale or sharing purposes
- Build or refine audience segments that include your data
What opt-out does NOT affect
Opting out does not prevent us from:
- Using essential or strictly necessary cookies required for site functionality (authentication, session management, fraud prevention)
- Processing transactional data needed to fulfill your requests (e.g., payment info, shipping address)
- Using service providers to support our business operations (e.g., cloud hosting, email delivery) that are not engaged in “sale” or “sharing”
- Analyzing aggregate or de-identified data that does not relate to you individually
Cookie clearing and persistence
Important notes:
- If you delete cookies from your browser or clear your browsing cache, your opt-out preference will be lost. You may need to opt out again.
- If you use a different browser or device, your opt-out preference may not apply. You will need to opt out on each browser/device.
- If you enable Global Privacy Control (GPC), your opt-out preference persists at the browser level and will be honored across visits (unless you disable GPC or change browsers).
4. Authorized Agents
You may authorize another person or entity to submit an opt-out request on your behalf. We call this an “authorized agent.”
Requirements
An authorized agent must:
- Provide a signed written authorization from you or a power of attorney
- Identify your name, contact information, and other information needed to verify your identity
- Submit the request in writing to the contact information provided in Section 7
Verification
We may require the authorized agent to:
- Demonstrate that they are authorized to act on your behalf (via a signed power of attorney or other documentation)
- Request that you verify your identity directly with us (we may call or email you)
We do not require the same level of identity verification for opt-out requests as we do for access or deletion requests. This is because an opt-out request is generally lower-risk than granting access to all your data.
5. Verification
Unlike access or deletion requests, opt-out requests do not require extensive identity verification. However, we may:
- Match information you provide against our records
- Ask you to confirm your email address or other contact information
- Take reasonable steps to prevent fraudulent or unauthorized opt-out requests
Non-discrimination
We will not discriminate against you for exercising your opt-out rights. We will not:
- Deny goods or services
- Charge you a different price or rate
- Provide a different quality of service or support
- Suggest that you will receive a different price or service if you do not opt out
To the extent permitted by law, we may offer you financial incentives (discounts, rebates, loyalty programs) that are reasonably related to the value of your data, provided we disclose such incentives clearly and allow you to opt in or out.
